TERMS OF SERVICE

Welcome to Tui Beauty. These Terms of Service (“Terms”) govern your access to and use of the Tui Beauty website, mobile applications, products, services, content, features and related platforms (collectively, the “Platform”).

By accessing, browsing or using the Platform, creating an account, placing an order, purchasing products or otherwise engaging with Tui Beauty, you acknowledge that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue use of the Platform.

1. General Conditions

1.1 Eligibility

You must be at least eighteen (18) years of age, or have the consent and supervision of a parent or legal guardian, to use the Platform and purchase products through the Platform.

1.2 Acceptance of Terms

By accessing or using the Platform, you agree to comply with these Terms, our Privacy Policy, and any additional policies, notices or guidelines published by Tui Beauty from time to time.

1.3 Changes to Terms

Tui Beauty may amend these Terms at any time. Updated Terms will be published on the Platform and will take effect immediately upon publication unless otherwise stated.

The version of these Terms in force at the time an order is accepted by Tui Beauty will govern that order.

Your continued use of the Platform after updated Terms take effect constitutes acceptance of the revised Terms for your future use of the Platform.

1.4 Accuracy of Information

You are responsible for ensuring that any information you provide to Tui Beauty, including account information, delivery details and contact information, is accurate, complete and up to date.

2. Products and Services

2.1 Product Information

Tui Beauty strives to ensure that all product descriptions, pricing, images, specifications, ingredient information and other content on the Platform are accurate. However, we do not warrant that such information is complete, current, error-free or entirely accurate.

Product packaging, ingredients, formulations and specifications may change from time to time without prior notice.

Customers should carefully review product labels, ingredient lists, directions for use and warnings before using any product.

2.2 Product Availability

All products displayed on the Platform are subject to availability.

Tui Beauty reserves the right to limit quantities, discontinue products, substitute products where appropriate, or cancel orders where products become unavailable.

2.3 Beauty and Skincare Recommendations

Any skincare advice, beauty recommendations, educational content, consultations, personalised suggestions, product matching or related content provided by Tui Beauty is for informational purposes only.

Such information does not constitute medical advice, dermatological advice, diagnosis or treatment and should not be relied upon as a substitute for professional medical advice.

Customers are solely responsible for determining whether a product is appropriate for their particular skin type, allergies, sensitivities, health conditions or personal circumstances. Customers with known allergies, sensitivities or medical conditions should consult a qualified healthcare professional before using any product.

2.4 AI-Powered Recommendations and Skin Analysis

Where Tui Beauty provides AI-assisted skin analysis, personalised recommendations or similar technology-enabled services, such services are based on information provided by the user and automated processing tools.

Tui Beauty does not guarantee the accuracy, completeness, effectiveness or suitability of any recommendation, analysis or result generated through such services.

Customers should exercise independent judgment before relying on or acting upon any recommendation, and should discontinue use of any product and seek medical advice if an adverse reaction occurs.

3. Orders and Payment

3.1 Order Acceptance

All orders placed through the Platform are subject to acceptance by Tui Beauty.

Tui Beauty reserves the right to refuse, cancel or limit any order at its sole discretion, including where:

a product is unavailable;
pricing or product information is inaccurate;
payment cannot be verified;
fraudulent or suspicious activity is suspected; or
compliance or legal concerns arise.

3.2 Payment

Tui Beauty accepts payment methods that may include mobile money services, card payments, bank transfers and other payment methods made available through the Platform.

All payments must be received and confirmed before an order is processed and dispatched, unless otherwise agreed in writing.

3.3 Pricing

All prices displayed on the Platform are subject to change without notice.

Tui Beauty reserves the right to correct pricing errors and cancel orders affected by such errors, provided that any payments received will be refunded where appropriate.

3.4 Taxes

Prices may include or exclude applicable taxes as indicated at checkout. Customers are responsible for any applicable duties, levies or taxes imposed by law.

4. Delivery

4.1 Delivery Services

Tui Beauty may engage third-party logistics and delivery providers to fulfil customer orders.

4.2 Delivery Timelines

Any delivery timelines communicated by Tui Beauty are estimates only and are not guaranteed.

Tui Beauty shall not be liable for delays arising from:

courier delays;
customs procedures;
weather conditions;
traffic disruptions;
strikes or labour disputes;
force majeure events; or
any circumstance beyond its reasonable control.

4.3 Customer Responsibilities

Customers are responsible for providing accurate delivery information.

Tui Beauty shall not be responsible for failed deliveries, delays, losses or additional costs arising from inaccurate or incomplete delivery instructions.

4.4 Risk and Ownership

Ownership of products passes to the customer upon receipt of full payment.

Risk in the products passes to the customer upon delivery to the address provided by the customer.

5. Returns and Refunds

5.1 Returns

If an item is incorrect, damaged, defective, missing, or has less than three (3) months remaining before its expiry date, the customer should contact Tui Beauty Customer Care within forty-eight (48) hours of delivery or collection.

The customer should provide the relevant order number and, where applicable, photographs or other information reasonably required by Tui Beauty to assess the issue.

Returns, refunds or other remedies will be subject to assessment and approval by Tui Beauty and applicable law.

5.2 Assessment

Returned products may be inspected before a refund, replacement or other remedy is approved.

Tui Beauty may request photographs, proof of purchase, delivery information or other reasonable evidence to assess a return or refund request.

5.3 Refunds

Approved refunds will be processed within five (5) to seven (7) business days through an appropriate payment method determined by Tui Beauty.

The applicable refund method may depend on the original payment method and the circumstances of the refund.

5.4 Additional Terms

6. Intellectual Property

6.1 Ownership

All content available on the Platform, including text, photographs, images, graphics, videos, product descriptions, logos, trademarks, software, databases, designs and other materials, is owned by or licensed to Tui Beauty and is protected by applicable intellectual property laws.

6.2 Restrictions

You may not copy, reproduce, distribute, modify, publish, display, exploit or create derivative works from any content on the Platform without Tui Beauty's prior written consent.

6.3 Trademarks

All trademarks, service marks, trade names and branding displayed on the Platform remain the property of their respective owners.

7. User Conduct

7.1 Acceptable Use

You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or interfere with the operation of the Platform.

7.2 Prohibited Activities

You shall not:

interfere with the security or functionality of the Platform;
provide false, inaccurate or misleading information;
engage in fraudulent or deceptive conduct;
attempt to gain unauthorised access to systems or accounts;
harass, abuse or threaten Tui Beauty personnel, representatives or other users;
upload malicious software or harmful code;
misuse customer service channels; or
engage in conduct that could damage the reputation, operations or legitimate interests of Tui Beauty.

7.3 Enforcement

Tui Beauty reserves the right to suspend, restrict or terminate access to the Platform and refuse future transactions where a user breaches these Terms or engages in conduct that Tui Beauty reasonably considers harmful or unlawful.

8. Privacy and Personal Data

Tui Beauty collects, uses, stores and processes personal data in accordance with its Privacy Policy.

By using the Platform, you acknowledge that personal data may be processed for the purposes described in the Privacy Policy, including order fulfilment, customer support, marketing communications, platform administration and compliance with legal obligations.

9. Disclaimer of Warranties

The Platform, products, content and services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Tui Beauty disclaims all warranties, representations and guarantees, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability and non-infringement.

Tui Beauty does not warrant that:

the Platform will operate uninterrupted or error-free;
defects will be corrected;
the Platform will be free from harmful components; or
products or recommendations will achieve any particular result.

10. Limitation of Liability

10.1 Product Use

Customers acknowledge that skincare, cosmetic and beauty products may affect individuals differently.

Tui Beauty shall not be liable for allergic reactions, sensitivities, adverse effects, dissatisfaction or other outcomes arising from the use of products, except to the extent liability cannot lawfully be excluded.

Customers are responsible for reviewing ingredients, warnings and usage instructions before using any product.

10.2 Recommendations and Analyses

Any recommendations, consultations, skin analyses, educational content or personalised suggestions are provided for informational purposes only.

Tui Beauty shall not be liable for decisions made or actions taken based on such recommendations.

10.3 Limitation of Liability

To the fullest extent permitted by law, Tui Beauty's total aggregate liability arising from any claim relating to the Platform, products or services shall not exceed the amount paid by the customer for the product or order giving rise to the claim.

10.4 Exclusion of Certain Damages

To the fullest extent permitted by law, Tui Beauty shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages, including loss of profits, revenue, goodwill, opportunity or data.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or liability arising from fraud or wilful misconduct.

11. Indemnity

You agree to indemnify, defend and hold harmless Tui Beauty, its directors, officers, employees, affiliates, agents and service providers from and against any claims, liabilities, losses, damages, costs and expenses arising out of:

your breach of these Terms;
your misuse of the Platform;
your violation of any law or the rights of any third party; or
any information provided by you that is inaccurate, misleading or unlawful.

12. Force Majeure

Tui Beauty shall not be liable for any delay or failure in performance resulting from events beyond its reasonable control, including acts of God, natural disasters, epidemics, pandemics, strikes, labour disputes, governmental actions, internet outages, telecommunications failures, supplier disruptions or transportation delays.

13. Suspension and Termination

Tui Beauty may suspend, restrict or terminate access to the Platform, cancel orders or discontinue services where:

these Terms are breached;
unlawful conduct is suspected;
fraud is suspected;
continued access may expose Tui Beauty to legal or operational risk; or
required by law.

Termination shall not affect any rights or obligations accrued prior to termination.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya.

The parties shall endeavour to resolve any dispute arising out of or relating to these Terms through good-faith negotiations.

Where a dispute cannot be resolved amicably within thirty (30) days, either party may refer the matter to the courts of Kenya, which shall have exclusive jurisdiction to hear and determine the dispute.

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Tui Beauty regarding your use of the Platform.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Failure by Tui Beauty to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.

15.4 Assignment

Tui Beauty may assign or transfer its rights and obligations under these Terms without restriction. Users may not assign their rights or obligations without Tui Beauty's prior written consent.
